Forte offers warranty options to help ensure that your organization continues accepting payments. All Forte-provided hardware components are covered by a one-year Standard Warranty, which covers the equipment from any operational defects and malfunctions. The Standard Warranty is included at no cost and also includes toll-free technical support.

For those organizations that require a higher degree of service and reliability, Forte offers an Extended Warranty option. With this option Forte provides advance replacement for defective equipment, includes free shipping, and ensures that your terminals are in top working condition. The Extended Warranty does require an extra fee, but may be canceled at any time.

Equipment Warranty

FORTE hereby offers as a service to Merchant the option to purchase a warranty on equipment ordered by Merchant through FORTE’s online equipment portal (the “Warranty”). The Warranty is limited in scope and duration pursuant to the terms herein.

1. EQUIPMENT: The Warranty is applicable solely to the equipment listed on the approved order receipt based on the order placed by MERCHANT and accepted through the FORTE online equipment portal (the “Equipment”).

2. WARRANTY TERM: For a period of one (1) year from the date of purchase of the Equipment (“Standard Warranty Period”), FORTE warrants the Equipment shall be free from defects in material and workmanship. Merchant may elect to extend the warranty beyond the Standard Warranty Period by selecting the “Extended Warranty” option, which will continue for as long as Merchant continues to make payment and will be billed on a monthly basis.

3. WARRANTY SUPPORT: FORTE will provide technical support for installation and operation of the Equipment. If at any time during the Standard Warranty Period or during the Extended Warranty the Equipment malfunctions, MERCHANT should call FORTE’s Technical Support department at 866-290-5400 or email at customerservice@forte.net to resolve the problem. If the Technical Support department is unable to resolve the issue and it is not attributed to a cause that is excluded from this Warranty, FORTE will immediately ship a replacement piece of Equipment to MERCHANT. MERCHANT will be responsible for packing and returning the defective unit to FORTE, using the prepaid shipping label included with the Equipment.

4. REMEDIES: FORTE’s sole obligations and MERCHANT’s exclusive remedies with respect to the Equipment determined to be defective shall be limited to repair, replacement or refund of the purchase price, at FORTE’s option. Replacement may constitute, at FORTE’s option, a new, refurbished or functionally equivalent piece of equipment. FORTE will reimburse MERCHANT for the cost of returning to FORTE the Equipment covered under this Warranty. If it is determined that Equipment returned for replacement is working properly or if it is determined that the Equipment failure was caused by Merchant’s failure to operate and maintain the Equipment in accordance with the applicable user’s manual, FORTE is authorized to charge MERCHANT the cost of the replacement Equipment based on the current list price for the Equipment provided. All remedies are expressly conditioned upon MERCHANT’s compliance with its obligations herein, including maintenance of the Equipment according to operating instructions and guidelines. If MERCHANT fails to comply with applicable operating instructions and guidelines, MERCHANT shall bear the full cost of any service, including but not limited to shipping, repair, replacement and return.

5. MERCHANT’S OBLIGATIONS: This Warranty is expressly conditioned on MERCHANT’s obligation to complete installation of, perform regular maintenance on and care for any equipment and supplies in accordance with any applicable operating instructions and guidelines for the Equipment, a copy of which MERCHANT acknowledges receiving and to which MERCHANT agrees to be bound. If MERCHANT does not comply with such instructions and guidelines, and that failure results in the need for replacement parts or replacement of the Equipment, MERCHANT shall bear the full cost of such replacement parts.

FORTE’S WARRANTY IS EXCLUSIVE, AND FORTE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

15. BINDING EFFECT: This Warranty and all of the covenants and conditions contained herein shall apply to and bind the parties and the heirs, legal representatives, successors and permitted assigns of the Parties.

16. GOVERNING LAW: This Warranty shall be governed by and construed in accordance with the laws of the State of Texas.
